GENERAL TERMS OF USE Article
1 - PURPOSE By
subscribing to L’Année philologique sur Internet [The
Philological Year on the Internet] (www.annee-philologique.com),
the L’Année philologique data bank produced by the Société
Internationale de Bibliographie Classique [the International Society
of Classical Bibliography] (hereinafter referred to as "the
Producer") and marketed by Les Belles Lettres publishing
company (hereinafter referred to as "the Distributor"),
the Client shall be deemed to have agreed to the terms and
conditions presented below. Article
2 - CENTRAL SERVERS 2.1-
Data bank contents are electronically distributed by one or more
central servers. 2.2-
Aside from periods of downtime required for maintenance, the servers
shall be accessible on a 24 hours/day, 7 days/week basis. They can
be accessed without any assistance from the server development
teams. 2.3-
Neither the Producer nor the Distributor shall be liable for any
technical incidents that may occur on networks over which they have
no control (whether related to telecommunications, electricity, or
other cause), or to any other act of God in accordance with
applicable law. ARTICLE
3 - DATA BANK ACCESS 3.1-
The Distributor shall supply the Client with all appropriate means
of access to query the L’Année philologique data bank. 3.2-
The Producer and the Distributor reserve the right to make any
modifications that they may deem necessary to improve the service.
In this event, the Client shall be informed in advance of any
possible consequences that such changes may cause. ARTICLE
4 - COMPUTER EQUIPMENT Use
of the L'Année philologique data bank shall be made from a
terminal installed on the Client’s premises at the latter’s sole
initiative and operated by said Client or by those persons whom he(she)
shall have so authorized. The terminal shall be linked to the
computer system of the central server(s) utilized by the Producer. ARTICLE
5 - DATA OWNERSHIP AND PROTECTION Any
rights to which the Client may be entitled shall, in no case
whatsoever, constitute
an assignment of the intellectual property rights of the L’Année
philologique data bank, which belong to the Producer who has
entrusted their distribution to Belles Lettres. The Client hereby
agrees not to reproduce the data, in whole or in part, for any
purpose other than his(her) own use and agrees not to directly, or
indirectly, exploit the data for commercial purposes, whether for a
fee, or free of charge. ARTICLE
6- LIABILITY 6.1-
LIABILITY OF THE CLIENT The
Client shall be solely responsible for any use that he(she) may make
of the L’Année philologique data bank, of any queries that
he(she) may submit, and of any use that he(she) may make of the
results obtained therefrom, including any absence of results. Should
the client fail to fulfil his(her) own obligations, neither the
liability of the Producer, nor that of the Distributor, can be
invoked. Neither
the Producer nor the Distributor shall be liable for any direct or
indirect damage that may result from any impossibility to access the
data bank, regardless of duration, nor for any use that may be made
of erroneous information contained in the Producer's data. 6.2-
LIABILITY OF THE PRODUCER AND OF THE DISTRIBUTOR Neither
the Producer nor the Distributor can warrant the accuracy, relevancy,
comprehensiveness, timeliness, reliability, or suitability for a
specific use of any information made accessible by the L’Année
philologique data bank. Any
liability on the part of the Producer and of the Distributor that
may be invoked on the basis of any legal suit whatsoever (whether of
a contractual, criminal or any other nature), and which shall be
related, in any manner whatsoever, to the data bank, cannot exceed
the total sums paid by the Client for its use. ARTICLE
7 - CONFIDENTIALITY The
Distributor and the Producer agree not to disclose any information
that would allow third parties to have specific knowledge of the
Client's queries. ARTICLE
8 - OTHER PROVISIONS 8.1-
These General Terms of Use shall be governed by French law. 8.2-
In the event of a dispute regarding the interpretation or execution
of any of these provisions, and in the absence of an amicable
arrangement between the parties, the Paris Commercial Court
[Tribunal de Commerce de Paris] shall have sole jurisdiction.
